Collaborative Law
We do our utmost to assist our clients with the difficult issues that surround these sensitive situations. Our Family Law practice group includes lawyers who have received training in the Collaborative Law Process and are accredited members of the Central Alberta Collaborative Lawyers Association, offering our clients a real alternative to the expense and difficulties of litigation. See www.collaborativelaw.ca for more information, or read more below.
Collaborative Law allows parties to work with their lawyers, and other professionals as required, to achieve an amicable resolution of their issues. The Collaborative Law Process allows parties to tailor their outcome to meet their specific needs and interests, and the needs and interests of their families, while avoiding the uncertainty, stress, time, and significant cost of the traditional Court system. The Collaborative Law process is confidential, and requires voluntary participation by both parties.
During the Collaborative Law Process, parties commit to exploring all possible resolutions during a series of without prejudice meetings, attended by both parties and their lawyers. Meetings are scheduled regularly, often resulting in a process significantly shorter than an experience in the traditional Court system. All of the Collaborative Law professionals involved in the Collaborative Law Process have received specific training relating to the process, including training in conflict management and interest based negotiation.
Both parties and their lawyers sign a Contract that requires all parties to negotiate in good faith, provide full and honest disclosure, and commit to finding an amicable resolution in a respectful manner. Participation in the Collaborative Law Process ensures all parties have the legal and financial information required to make informed decisions, without the fear and stress of an impending Court application. The Collaborative Law professionals are prevented from representing the parties outside of the Collaborative Process, which ensures all parties are motivated and committed to finding the best possible resolution for all parties involved.
